1. Seller's identity and general

  1. The website sensualjaffa.co.il (the "Site"), trading under the name Sensual Unique Perfumes, is operated by Yana Shtilman, licensed dealer (עוסק מורשה) no. 316843804, of Pinchas Ben Yair 3, Tel Aviv-Yafo (the "Seller").   2. These Terms apply to every purchase made on the Site, by WhatsApp or by telephone. They are accessible from every page of the Site and before an order is completed.
  3. Nothing in these Terms derogates from any right conferred on a consumer by law. The provisions of the Consumer Protection Law apply notwithstanding any waiver or contrary agreement. [s. 36, Consumer Protection Law]

2. The products and how they are prepared

  1. The Site sells portions (decants) of original perfumes in 3, 5 and 10 ml sizes, together with the Seller's own line.
  2. A decant is poured from an original bottle lawfully acquired by the Seller into a standard vial, according to the customer's selection from a fixed list of fragrances and volumes. The perfume is not diluted, altered or re-manufactured.
  3. Every vial is marked with the fragrance name, the net volume in millilitres, the Seller's name and address, and the country of manufacture, in Hebrew. [Consumer Protection Order (Marking of Goods), 5743-1983, regs. 2, 3 and 4]
  4. The Seller is not an agent, distributor or representative of any brand owner and does not act on their behalf.
  5. Safety warnings: perfume contains alcohol and is flammable. Keep away from fire and heat and out of the reach of children, avoid contact with the eyes, and discontinue use if irritation occurs. A patch test on a small area of skin before use is recommended. [s. 3(a)(2), Defective Products Liability Law, 5740-1980]

3. Prices

  1. Displayed prices are the total price, include VAT and are quoted in new shekels only. [ss. 17A and 17D, Consumer Protection Law]
  2. Delivery charges are shown separately and are added at checkout.
  3. The binding price is the price displayed at the time the order is placed. [s. 17B(d), Consumer Protection Law]

4. Ordering, payment and invoice

  1. A purchase made on the Site, by WhatsApp or by telephone is a distance sale transaction. [s. 14C(f), Consumer Protection Law]
  2. Card payment is made on a secure Hyp payment page. The Seller does not see, receive or store card details.
  3. The order is concluded when the card issuer approves the charge and the Seller sends an order confirmation. Acknowledgement of receipt of an order does not bind the Seller where the item is out of stock.
  4. A tax invoice or receipt is issued for every payment and sent to the email address provided. [ss. 45 and 47(a), Value Added Tax Law, 5736-1975]
  5. No later than the time of supply, the customer will be sent a written document, in Hebrew or in the language in which the marketing approach was made, setting out the Seller's particulars and the product's characteristics, the price and payment terms, the manner in which the cancellation right may be exercised, the manufacturer's name and country of manufacture, and warranty information. 5. Delivery

  1. Courier to the door: 40 ₪, generally within one business day of order confirmation, Sunday to Thursday.
  2. Collection from the studio at Pinchas Ben Yair 3, Tel Aviv-Yafo, free of charge, by prior arrangement.
  3. Delivery is within Israel, subject to the courier's service areas. Where an address cannot be served, we will contact the customer and offer collection or a full refund. 6. Cancellation, returns and refunds

  1. The customer may cancel the transaction from the day it is made until fourteen days from the day the product is received or from the day the document under clause 4.5 is received, whichever is later. [s. 14C(c)(1), Consumer Protection Law]
  2. A customer who is a person with a disability, a citizen aged 65 or over, or a new immigrant within five years of the issue of their immigrant certificate or certificate of entitlement, may cancel within four months, provided the transaction involved a conversation between the parties, including by WhatsApp, chat or email. The Seller may require one document evidencing this and no further proof. [s. 14C1(c) and (d), Consumer Protection Law]
  3. A cancellation notice may be given orally by telephone, by registered post, by email, and through the cancellation page reached by a dedicated link on the Site's home page. The notice shall state the customer's name and identity number. [s. 14I(a), (b) and (c), Consumer Protection Law]
  4. Where the transaction is cancelled on account of a defect, a discrepancy between the product and the particulars given, failure to supply on time, or any other breach by the Seller, the full amount paid is refunded within 14 days of receipt of the cancellation notice, with no cancellation fee. The customer shall make the product available to the Seller at the place where it was delivered, and the Seller shall collect it at its own expense. [s. 14E(a), Consumer Protection Law]
  5. Where the transaction is cancelled because the customer has changed their mind, the amount paid, including the delivery charge, is refunded within 14 days of receipt of the cancellation notice, less a cancellation fee of 5% of the transaction price or ₪100, whichever is the lower. No other amount is charged, including shipping or packaging expenses, which form part of the cancellation fee. The customer shall return the product to the studio at their own expense.   6. Opening the vial or spraying it to try the fragrance does not forfeit the cancellation right. This does not derogate from the Seller's right to claim its loss where the product's value has fallen as a result of a significant deterioration in its condition. [s. 14E(c), Consumer Protection Law]
  7. The cancellation right under clause 6.1 does not apply to a product made especially for the customer following the transaction to that customer's individual requirements, such as a blend composed to their brief or a vial engraved with their name. A standard-size portion of a fragrance from the range shown on the Site is not such a product, and the cancellation right applies to it in full. [s. 14C(d)(4), Consumer Protection Law]
  8. A purchase made physically at the studio is governed by the Consumer Protection Regulations (Cancellation of a Transaction), 5771-2010, including the conditions that the goods are undamaged and unused and that their price exceeds ₪50. [regs. 1, 2 and 5 of those Regulations]

7. Warranty and non-conformity

  1. The customer shall examine the product immediately upon receipt and notify the Seller of any non-conformity immediately thereafter. [ss. 13 and 14, Sale Law, 5728-1968]
  2. Where the non-conformity could not have been discovered on a reasonable examination, the customer may rely on it provided notice is given immediately upon discovery. [s. 15, Sale Law]
  3. Nothing in these Terms exempts the Seller from liability for bodily injury or a malicious act, or limits the customer's right to apply to the courts. [ss. 5(a) and 5(b), Standard Contracts Law, 5743-1982; s. 7, Defective Products Liability Law, 5740-1980]

8. Intellectual property

  1. The perfume names and trade marks appearing on the Site are the property of their owners. They are used solely to describe truly the nature of the goods sold. [s. 47, Trade Marks Ordinance [New Version], 5732-1972]
  2. The products sold are portions of original perfumes lawfully acquired. The Seller has no connection with, sponsorship from or authorisation by the brand owners, and no such connection is to be inferred.
  3. The Site's design and the photographs and texts created by the Seller are protected by copyright and may not be copied without written permission.

9. Privacy

  1. Personal data is processed in accordance with the Site's Privacy Policy, which forms an integral part of these Terms. [s. 11, Protection of Privacy Law, 5741-1981]

10. Governing law and jurisdiction

  1. These Terms and any transaction under them are governed exclusively by the laws of the State of Israel.
  2. The competent courts of the Tel Aviv-Yafo District shall have jurisdiction. This does not derogate from a consumer's right to bring a claim before any other competent court under the law. [s. 4(9), Standard Contracts Law]
